Trademark Registration -- How To
Start with: Basic Information
Actual Page To Start Registration:
So far I have determined that the "class" of trademark should be "Nutritional Supplements" Class 005
My first success is recorded on this page.
The word "ayurceutical" did not have any matches on google! My search in trademarks did not show it and I have applied for the Trademark.
Did you mean: agriceutical
No standard web pages containing all your search terms were found.
Your search - ayurceutical - did not match any documents.
I then also looked up "ayurcream" in Google;
The name was found once for a web site and also found for a listing by Whois to show that there was a web name available to purchase. It appears that someone has figured the name might be useful and put up a hodgepodge of content, but mostly wants to sell the name.
Undoubtedly www.ayurcream.org would be available, and would be just as useful since the "first level domain" names are taking on much less importance to search engines and the public.
There is an extensive web site there, but it is a mixture of features including a dating service, stock trading, food storage, etc.
I doubt very much if they have attempted to register a trademark (because of the cost and trouble) and there is no place I saw the word "ayurcream" used in any way other than as part of the web address.
I'll try "magicream" first. I found in the Trademark Search several names like "magixxx" but none that had the exact word "magicream."
So, I'll go for it in Google. I found one web site using that name, two links to Emmessar and one more that uses the term. None of them have ™ showing. As I understand the trademar law, it is the FIRST USE in commerce that gives you the right to trademark the mark, but you may have to fight someone else to prove that you used it before they did.
So, when you register a mark with the Trademark Office, you have simply established a DATE that is strong evidence in a dispute. If someone else can prove they were using the name (even though not registered) BEFORE you, they win the fight. But that can be lengthy.
Emmessar could/should use the ™ mark to notify the public that the name has been registered.

I'm not going to try to apply for "MagiCream" but will take the risk on "Ayurcream." Since that word has some existence on the web, but not apparently directly associated with a product I will probably get through the application with no problem. We can then use
Ayurcream™ imediately, and defend against any one who claims prior use because we, presumably, have the application in to establish our date (which will be only today!).
